State by State Refund Policy

Lear Capital, Inc. ("LCI") offers a 24-hour cancellation period to all customers. In addition, LCI offers the following additional refund policies for residents of the States listed below.

Where a policy below contains an *: In instances where LCI transfers precious metals to a storage facility or retirement account, "receipt" or "delivery" of goods is considered to occur on the date that the customer receives written confirmation that LCI has finalized the transfer.

Neither LCI's Transaction Agreement nor these State-specific policies disclaim oral representations where statutes disallow such disclaimers.

Alabama

LCI will provide a full refund, credit, or replacement, at the customer's option, if: (1) the goods are defective, not as represented, or not received as promised; or (2) within 7 days after the customer's receipt* of the goods, the customer returns the goods or makes a request for refund, credit, or replacement to LCI. All requests must be made to LCI by phone at 888-806-5945, by email to transaction@learcapital.com, or by mail or delivery to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025. All returns must be mailed or delivered to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025. LCI will process the refund or credit to the customer's credit card account within 30 days of LCI's receipt of the undamaged returned goods. If a customer returns only a portion of the goods, the refund, credit, or replacement will be prorated accordingly. LCI's Alabama registration number is 11-105ALTM.

Alaska

LCI will provide a full refund, credit, or replacement, at the customer's option, if: (1) the property purchased is defective, not as represented, or not received as promised by LCI; or (2) within 7 days after the customer's receipt* of the purchased property, the customer returns the property or makes a request for refund, credit, or replacement to LCI. All requests must be made to LCI by phone at 888-806-5945, by email to transaction@learcapital.com, or by mail or delivery to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025. All returns must be mailed or delivered to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025.

Arizona

You may cancel an order without any penalty or obligation within 3 business days from the delivery* of the merchandise or premium (gift, bonus, prize or award), whichever is later. If you cancel, any payments made by you will be returned within 10 days after the seller's receipt of your notice of cancellation or, if goods have been sent to you, within 10 days after the seller's receipt of the undamaged returned goods. To cancel a transaction, call LCI at 888-806-5945, email transaction@learcapital.com, or mail or deliver a signed and dated copy of your cancellation notice or send a telegram to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025. If you cancel, any merchandise or premium delivered to you must be returned at our expense to the above address no later than 21 business days after the receipt* of this merchandise or premium, whichever is later.

California

You, the buyer, may cancel a transaction at any time prior to midnight of the third business day after your receipt* of any products. See the below Notice of Buyer's Right of Cancellation for an explanation of this right.

NOTICE OF BUYER'S RIGHT OF CANCELLATION

You may cancel a transaction, without any penalty or obligation, within three business days following your receipt* of any products and this notice of cancellation.

If you cancel, any payments made by you or authorized by you, pursuant to any telephonic solicitation and purchase agreement shall be returned to you within 10 days following the seller's receipt of your cancellation notice or, if goods have been sent to you, within 10 days following the seller's receipt of the undamaged returned goods.

If you cancel, you must make available to the seller at your residence, in substantially as good condition as when received, any goods delivered to you under this contract, agreement, or sale, or you may, if you wish, comply with the instructions of the seller regarding the return shipment of the goods at the seller's expense and risk.

LCI will provide a full refund for the return of undamaged and unused goods, provided the customer gives notice of cancellation to LCI within 3 business days after the customer's receipt* of the goods. LCI will process the refund within 30 days of LCI's receipt of the undamaged returned goods.

Connecticut

LCI will provide a full refund for the return of undamaged and unused goods within 7 days after the customer's receipt* of the goods. LCI will process the refund within 30 days of LCI's receipt of the undamaged returned goods.

Delaware

YOU, THE BUYER, MAY CANCEL A TRANSACTION AT ANY TIME WITHIN 8 DAYS AFTER YOUR RECEIPT* OF THE GOODS. SEE THE BELOW NOTICE OF CANCELLATION RIGHT FOR AN EXPLANATION OF THIS RIGHT.

You may cancel a transaction, without any penalty or obligation, within 8 days after your receipt* of the goods. If you cancel, any property traded in, any payments made by you under the contract or sale and any negotiable instrument executed by you will be returned within 10 business days following the seller's receipt of the cancellation notice or, if goods have been sent to you, within 10 business days following the seller's receipt of the undamaged returned goods.

If you cancel, you must make available to the seller at your residence, in substantially as good condition as when received, any goods delivered to you under this contract or sale; or you may if you wish comply with the instructions of the seller regarding the return shipment of the goods at the seller's expense and risk.

BUYER'S RIGHT TO CANCEL

LCI will provide a full refund, credit, or replacement, at the customer's option, if (1) the goods are defective, not as represented, or not received as promised; or (2) the customer returns the goods or makes a request for refund, credit, or replacement to LCI within 7 days of the customer's receipt* of the goods. If the customer returns only a portion of the goods, the refund, credit, or replacement will be prorated accordingly.

You are not obligated to pay any money unless you sign the Transaction Agreement and return it to the seller.

Hawaii

LCI will provide a full refund for the return of undamaged and unused goods, provided that the customer returns the goods within 8 days after the customer's receipt* of the goods. All returns must be mailed or delivered to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025. LCI will process the refund within 30 days of LCI's receipt of the undamaged returned goods.

YOU ARE NOT OBLIGATED TO PAY ANY MONEY UNLESS YOU SIGN THE TRANSACTION AGREEMENT AND RETURN IT TO THE SELLER.

Idaho

NOTICE OF CANCELLATION RIGHT

If you are a first-time buyer from LCI, you have the following additional right to cancel your first purchase:

You may cancel your first transaction, without any penalty or obligation whatsoever, within three (3) business days of the date on which you receive the written invoice of the transaction. If you cancel, all payments or other consideration which may have already been made by you will be returned within ten (10) business days following LCI's receipt of your cancellation notice or, if goods have been sent to you, within ten (10) business days following LCI's receipt of the undamaged returned goods. If you cancel, you must make available to LCI at your residence, in substantially as good condition as when received, any goods delivered to you under this contract, agreement, or sale, or you may, if you wish, comply with LCI'S instructions regarding the return shipment of the goods at the seller's expense and risk.

Indiana

A customer may cancel a transaction and receive a full refund for the return of undamaged goods if the customer provides notice of cancellation to LCI or returns the goods within seven (7) days of the customer's receipt* of the goods. Notice of cancellation must be provided to LCI by phone at 888-806-5945, by email to transaction@learcapital.com, or by mail or delivery to Lear Capital, Attention: Customer Service, 1990 S. Kentucky

NOTICE OF CANCELLATION RIGHT

IF YOU AGREED TO BUY THESE GOODS AS A RESULT OF AN UNSOLICITED TELEPHONE CALL, KENTUCKY LAW GIVES YOU FOURTEEN (14) DAYS TO CANCEL YOUR AGREEMENT WITH US. IF YOU WANT TO CANCEL, YOU MUST RETURN ANY GOODS YOU HAVE RECEIVED AND A NOTICE OF CANCELLATION TO LCI SO THEY ARE POSTMARKED NO LATER THAN MIDNIGHT OF THE FOURTEENTH DAY FOLLOWING THE DATE YOU RECEIVED* THE GOODS, OR THE FOURTEENTH DAY FOLLOWING THE DATE YOU RECEIVED THIS NOTICE, WHICHEVER IS LATER. LCI will process the refund within 10 days following LCI's receipt of the cancellation notice or, if goods have been sent to you, within 10 days following LCI's receipt of the undamaged returned goods.

CONSUMER'S RIGHT TO CANCEL

Maryland

If you are a first-time buyer from LCI, you have the following additional right to cancel your first purchase:

A first-time buyer from LCI can obtain a full refund for the return of undamaged and unused goods to LCI within 7 days after the customer's receipt* of the goods. Massachusetts

You may cancel a transaction if it has been entered into by a party thereto at a place other than an address of the seller, which may be its main office or branch thereof, provided you notify the seller at its main office or branch by telephone, by email, by ordinary mail posted, or by telegram sent or by delivery, not later than midnight of the third business day following your receipt* of the goods. You, the buyer, may cancel a transaction at any time prior to midnight of the third business day after the date you receive* the goods. Additionally, the seller is prohibited from having an independent courierservice or other third party pick up your payment at your residence before the end of the 3-business-day period in which you can cancel the transaction.

If you do not want the goods you purchased, you may cancel your purchase by providing notice of cancellation to LCI, not later than midnight of the third business day after you receive the invoice for the transaction. Mississippi

If you are a first-time buyer from LCI, you have the following additional right to cancel your first purchase:

LCI will provide a full refund for the return of undamaged and unused goods within 7 days after the customer's receipt* of the goods. All returns must be mailed or delivered to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025. LCI will process the refund within 30 days of LCI's receipt of the undamaged returned goods.

Montana

YOU, THE PURCHASER, MAY CANCEL A SALE WITHOUT ANY PENALTY OR OBLIGATION WITHIN 7 DAYS AFTER THE DATE OF THE DELIVERY* OF THE GOODS.

If you cancel, any payments made by you under the sale will be returned within 10 days of the day your notice of cancellation is received by the seller or, if any goods have been sent to you, within 10 days of the day the undamaged returned goods are received by the seller; and any security interest connected to the transaction will be canceled.

If you cancel, you must make available to the seller at your residence, in substantially as good condition as when received, any goods delivered to you under this sales contract; or you may, if you wish, comply with the seller's instructions regarding returning the goods at the seller's expense and risk.

To cancel a transaction, you must provide notice of cancellation to LCI (legal name Lear Capital, Inc.) within 7 days after the date of delivery* of the goods, by phone at 888-806-5945, by email to transaction@learcapital.com, or by mail or delivery to Lear Capital, Attention: Customer Service, 1990 S. Nebraska

LCI will provide a refund for the return of undamaged and unused goods, provided that the customer returns the goods to LCI within 8 days after the customer's receipt* of the goods. All returns must be mailed or delivered to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025. LCI will process the refund within 30 days of LCI's receipt of the undamaged returned merchandise.

Nevada

LCI will provide a full refund or replacement, at the customer's option, if: (1) the goods purchased are defective or not as represented; and (2) within 30 days after the customer's receipt* of the goods or any gift or premium, whichever is later, the customer returns the unused goods at LCI's expense or makes a request for refund or replacement to LCI. All requests must be made to LCI by phone at 888-806-5945, by email to transaction@learcapital.com, or by mail or delivery to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025. All returns must be mailed or delivered to Lear Capital, Attention: Customer Service, 1990 S. Bundy Drive, Suite 650, Los Angeles, CA 90025. LCI will process the refund or replacement within 14 days after LCI's receipt of the request or, if goods have been sent to the customer, within 14 days after LCI's receipt of the undamaged returned goods. If the customer returns only a portion of the goods, the refund or replacement may be prorated accordingly.

New Hampshire

ANY BUYER MAY CANCEL A TRANSACTION ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THE INVOICE FOR THE TRANSACTION. See the below Notice of Cancellation Right for an explanation of this right.

NOTICE OF CANCELLATION RIGHT

To cancel a transaction, either provide notice of cancellation or return the merchandise to LCI, NOT LATER THAN MIDNIGHT OF THE THIRD BUSINESS DAY after the date of the invoice for the transaction. If you cancel, any property traded in, any payments made by you under the contract or sale, and any note or other evidence of indebtedness given by you pursuant to or in connection with the sale will be returned within FIFTEEN DAYS following LCI's receipt of your cancellation notice or, if goods have been sent to you, within FIFTEEN DAYS following LCI's receipt of the undamaged returned goods.

New Mexico

If you are a first-time buyer from LCI, you have the following additional right to cancel your first purchase:

If you cancel, you must make available to LCI at your residence, in substantially as good condition as when received, any goods delivered to you under this contract or sale; or you may, if you wish, comply with the instructions of LCI regarding the return shipment of the goods at LCI's expense and risk.

North Dakota

LCI will provide a full refund for the return of undamaged and unused goods, provided that the customer requests a refund no later than 15 days after the customer's receipt* of the goods. Ohio

NOTICE OF CANCELLATION RIGHT

Because you agreed to buy these goods as a result of a telephone solicitation, Ohio law gives you seven (7) days to cancel your purchase. If you cancel, LCI will provide you a full refund within ten (10) business days following LCI's receipt of your cancellation notice or, if goods have been sent to you, within ten (10) business days following LCI's receipt of the undamaged returned goods; and any security interest arising out of the transaction will be cancelled.

If you want to cancel, you must provide notice of cancellation to LCI no later than midnight of the seventh day following the date you received* the goods, or the seventh day following the date you received this notice, whichever is later. Notice of cancellation must be provided to LCI by phone at 888-806-5945, by email to transaction@learcapital.com, or by mail or delivery to Lear Capital, Attention: Customer Service, 1990 S. If you cancel, you must make available to LCI at your residence, in substantially as good condition as when received, any goods delivered to you under this contract or sale; or you may if you wish, comply with LCI's instructions regarding the return shipment of the goods at LCI's expense and risk.

A consumer may opt to return the goods by U.S. Postal Service, in person, or by the same method as shipped to the consumer.
